Allgemeine Geschäftsbedingungen (AGB)

§ 1 Geltungsbereich, Vertragspartner

„Return to Cart“ jederzeit korrigieren.

Terms and Conditions (English translation)

The German text above is the legally binding version; this translation is provided for your convenience.

1. Scope, contracting party

(1) These terms apply to all orders placed in our online shop circuitvalley.de. Your contracting party is Gaurav Singh, CircuitValley (address and contact details: see Impressum).

(2) A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 BGB). A business customer is a natural or legal person or partnership acting in the exercise of its trade, business or profession (§ 14 BGB).

(3) Deviating terms of the customer apply only if we expressly agree to them in writing.

2. Conclusion of the contract

(1) The presentation of products in the online shop is not a legally binding offer but an invitation to order.

(2) By clicking “Buy now” or by completing the payment with PayPal you make a binding offer to purchase the goods in your cart. Before submitting, you can check all entries and correct them at any time using the input fields or “Return to Cart”.

(3) The automatic e-mail after your order only confirms its receipt and is not yet an acceptance of your offer.

(4) The contract is concluded when we receive the purchase price: for PayPal payments when the payment is completed at PayPal; for bank transfers when the amount is credited to our account. No separate declaration of acceptance is required (§ 151 BGB). You are bound by your order for seven days from submitting it; if payment is not received within this period, no contract is concluded.

(5) The contract languages are German and English.

(6) We store the contract text. You receive your order details by e-mail; with a customer account you can view your orders under “My account”. You can view, print and save these terms on this page at any time.

3. Prices and shipping costs

(1) All prices are final prices. As a small business under § 19 of the German VAT Act (UStG) we do not charge and therefore do not show VAT.

(2) Shipping costs may apply in addition; they are stated on the Shipping and Returns page and during checkout.

(3) For deliveries outside the EU, customs duties, import taxes and fees may apply, which are borne by the customer.

4. Payment

You can pay with PayPal (including the payment methods offered there, e.g. credit or debit card) or by bank transfer in advance (prepayment). For bank transfers you receive our bank details by e-mail. Goods are shipped after payment has been received.

5. Delivery

(1) We ship worldwide with very few exceptions. Shipping methods and delivery times are stated on the Shipping and Returns page and, where applicable, on the product page; for prepayment the delivery time starts on the day after payment is received.

(2) If an ordered item is not available, we will inform you without delay and refund any payments already made without delay.

6. Retention of title

The goods remain our property until paid in full.

7. Right of withdrawal

Consumers have a right of withdrawal as set out in our Widerrufsbelehrung / Right of Withdrawal. Business customers have no statutory right of withdrawal.

8. Warranty

(1) The statutory warranty rights apply.

(2) For business customers the limitation period for claims for defects is one year from delivery. This does not apply to claims for damages under section 9, in case of fraudulent concealment of a defect, where a guarantee was given, or in the cases of §§ 445a, 445b, 478 BGB. For merchants, the duty to inspect and give notice of defects under § 377 HGB applies.

9. Liability

(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and to the extent of any guarantee we have given.

(2) In case of a slightly negligent breach of an essential contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance the customer may regularly rely), our liability is limited to the foreseeable damage typical for the contract.

(3) Otherwise, liability for slightly negligent breaches of duty is excluded. These limitations also apply in favour of our vicarious agents.

10. Applicable law, place of jurisdiction

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of the country of their habitual residence.

(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is our place of business.
